ss. ♪ and driving progress is what we do every day. ♪ ♪ governor john of ohio announcing his state has joined those on president obama's list for federal assistance tonight. emergency situations pop-up all over his state, following severe weather. deadly storm system packing hurricane force winds moving across the eastern half of the country this weekend along with a punishing heatwave. i'm harris faulkner this is the fox report. first, the millions of americans without electricity at this hour after storms chewed up parts of seven states plus the district of columbia.

this video taken in d.c., line of powerful thunderstorms with winds of more than 80 miles per hour and heavy rain tearing through several states leaving a path of destruction that has killed at least 12 people. one person confirmed missing. survivor describes the chaotic scene in his town in west virginia. >> wind and debris swirling everywhere, flying around hitting every car in sight. >> next thing dust cloud came and everything started ripping off the building, smashed cars, road was covered, pretty much tore everything up. >> harris: also in west virginia this video showing a large white object draped over a power line that is a rooftop ripped off a house. >> i'm glad my kids were in bed. i'm glad they weren't in here. >> harris: that mom in ohio holding back tears, blessing

for her to count. her little ones were not in their beds when a tree tore a hole through their home. people sifting through the aftermath major delays on amtrak tonight from our nation's capital to philadelphia after service was cut for hours earlier. now we are learning about a hard -- harrowing ordeal for 2232 amtrak passengers stuck on a -- 232 amtrak passengers stuck on a train for 12 hours, trees blocking the tracks, they had to sit there. this happened outside of west virginia the train traveling originally from new york city to chicago. amtrak spokesperson saying all the passengers have just been loaded on to buses to get them to their destinations. in virginia six of the 12 confirmed dead were from there. doug, a long hot night ahead for survivors? >> reporter: boy it sure is harris this is a house behind

me you can't see it because of the debris. the family who lives here has been working all day long in very intense heat, near 100°, to clean it up like millions of families across the mid atlantic seaboard. damage from this one line of thunderstorms stretched in the west from indiana to new jersey in the north and to roanoke, virginia in the south. governor o'malley in maryland put the damage in his state in this perspective. >> i can only say talking to our public service people they are comparing this outage to hurricane irene. statewide it is on par with hurricane irene. it is more spread out in some ways than hurricane irene was other storms have maybe hit one area of the state harder than another this is on the scale of irene in terms of the damage across the state. >> reporter: power crews from 12 different states and as far

north as canada are being descended upon this area to help with the restoration of power but not expected to get underway until monday here are the latest power outage numbers right now, maryland 869,000 without power. west virginia 600,000, ohio one million, d.c. of 7,000. pennsylvania 32,500, indiana 135,000, kentucky and north carolina minimally hit single greatest damage in the state of virginia 2.5 million people were without power earlier today. even at this late hour if you drive across northern virginia the suburbs of d.c., nine out of every traffic light -- out of every 10 traffic light without power. shopping centers are without power. it is no wonder authorities are telling people to be prepared for lasting a week in this intense heat without power. >> harris: that is brutal.

doug, before we let you go i mentioned the fact that half of the deaths confirmed happened in that state. you have the story of one family particularly. >> reporter: yeah earlier today we were doing live shots a from here. a main thoroughfare down there, a big tree fell landed on top of a car crushing and killing a 26-year-old man while were doing live shots down there today his family showed up at the scene them are buddhists they brought a monk with them, we saw a woman lean up against the tree and collapse in grief. a terrible, terrible situation. they had gathered today hoping to celebrate a family birthday. instead, they are mourning a death. terrible situation. >> harris: doug, thank you very much. heat playing a role in another disaster in colorado, the waldo canyon fire the largest

in the state's history still burning out of control, two dead, 350 homes destroyed. still, a sliver of hope, crews are gaining the upper handsome evacuees are getting word they may soon be able to go home. >> i've been coming up here for three four of these sessions thinking this might be the time they lift our evacuation. tonight was the time. we are relieved we get to go home. we know there's many that can't and won't be for a long time. >> harris: fire crews making progress on the high park fire chewed up 250 homes, now fully contained expected tomorrow. the last evacuation orders in that area are being lifted tonight. alicia is in colorado springs and has the latest. >> reporter: the weather was a huge asset to firefighters today with cooler temperature and cloudy skies they were able to increase the containment to 45%, an improvement from 30% from this

morning's update. which is why city and county officials were able to announce they will be able to allow more evacuees to begin going back home tomorrow. however, they also announced there is a new and dangerous problem. >> i say that with some slight hesitation. before we can completely be comfortable with the return of those reresidents we need to get some gas services restored. they have to lay some power line poles back in that were destroyed in the fire. and we've actually had an invasion of bears in green mountain falls. we are working with dow to try to persuade them to vacate the area. >> reporter: as crews remain optimistic, they are also keeping in mind the fact this is a fire like none so many of them have seen if you look at this video you can see how the wind moved the flames through so fast they destroyed some homes while leaving their neighbors untouched.

during our latest update, officials talked about the potential for this to turn around. 22 homes have been broken into by looters. police have made one arrest. many of the thousands of evacuees packed their cars full of belongings and have been living in hotels. law enforcement officials are getting reports of cars that belong to the evacuees being broken into. people trying to steal what little some of these residents have left. the national guard is now here assisting colorado springs police in keeping the peace and watching the streets. >> harris: alicia, thank you. cooler temperatures there helping out, weather playing a huge role in many of your lives this weekend. watching the forecast for us, meteorologist justin, the heatwave taking up most of the nation's weather map. >> that's right. of course we expect hot temperatures this time of the year heading into week two of summer officially. we don't like to see this much heat, temperatures breaking records from denver, colorado

eastbound to atlanta, georgia up into the upper 100s this afternoon. a clash of the air masses has fueled these giant clusters of storms. yesterday's cluster historic. these have been rolling quickly east and southeast cooler to the north warmth and humidity to the south, clash of the air masses dangerous recipe for severe weather. >> harris: we heard our correspondent in colorado saying cooler temperatures helped. not everybody is as hot as everybody else right now. >> that's right. the core of the heat is centered across the plain states slicing throughout the deep south. we will see some of this heat retreat and build back into the front rages not good news also aided by low relative humidity and dry thunderstorms. we need the rain throughout colorado and new mexico. some of these thunderstorms are producing more damage rather than help with gusty winds and lightning definitely not good news for combating

some of these fires. some rainfallhs, but heat is on as we go into sunday and next week. >> harris: the high park fire sparked originally by lightning that with the cooler temperatures unfortunately is in their forecast. thank you very much justin. new fallout from the u.s. supreme court's landmark decision upholding president obama's health care reform law. florida governor rick scott saying his state will not come lie with the law. he joins -- comply with the law he joins the list of others. big names in the republican party, including indiana governor dan chelce, new jersey government and louisiana governor. they don't want to saddle their states with mandated changes to medicaid coverage in setting upstate run health insurance programs. in today's weekly gop address wyoming senator barrasso lashing out at president obama -- at president obama for introducing what he calls a new tax to pay for it.

>> the president and his allies in congress are going to try to convince the public the supreme court just gave the health care law a seal of approval. the fact is this is the same failed policy that won't lower the cost of health care in america. thursday i was in the courtroom as the supreme court ruled the health care law was what the president claimed was not, a new tax. >> harris: congressman engall defending the law earlier saying the mandate that forces people to buy insurance is not a tax. >> bottom line is, we currently have 50 million americans who are uninsureed. you want to know what a tax is? when they go into the emergency and you and i have to pay for it. what this health care act is going to eliminate that because everyone is going to have insurance. and the so-called tax is only going to affect those people who don't buy insurance who can afford to buy insurance and don't. the average person that has

insurance this is not going to effect them one io >> harris: the issue has jumped back to the forefront of the election battle between the president and governor romney. the governor hoping to use the supreme court ruling as a rallying cry pledging to repeal the law as soon as he takes office. >> right now secretary of state clinton hinting at the possibility of military intervention in syria, new development coming on the heels of a summit that wrapped up today, aimed at ending the bloodshed there when it was over secretary clinton calling for syrian president assad to step down and the united nations security council to authorize military action. >> we are dealing with not only a murderous regime, in a combustible region, but the potential for that region to be gravely affected by the continuance of this violence.

lt. tisdale was 42-years-old who served in iraq and afghanistan. a member of his own battalion allegedly shot him and wounded another soldier and turned the again on himself. the suspect not expect today to survive. the alleged shooter was facing a possible court-martial after being accused of stealing a tool box from a military facility. now to the trouble for our nation's police in the sky. the transportation security administration just fired eight air marshals for some very inappropriate behavior. the group busted for drinking on-the-job during a training session in new york. another six facing suspension because they didn't report it. molly line is here with me. tsa is taking this seriously. >> reporter: absolutely this is another example of a federal agency involved in our nation's security having an issue, a problem where they are feeling embarrassed, taking action after things

have happened. transportation security administration is what they are talking about now. they say 14 employees of the federal air marshal service are being disciplined or terminated, over this incident. the drinking is what we are talking about which occurred in february at a restaurant during lunch not far from the new york field office near jfk. the marshals were not expecting to that day but were participating in training on the clock and the drinking was reported later via a website where employees can pass on unethical behavior. alcohol cannot be consumed when employees are working. tsa saying: >> so they took act. >> harris: you were allude together u.s. secret service scandal when you say a couple

have been mentioned with security companies or security employees. firing is tough. >> reporter: definitely. we had a chance to speak with former dea special agent he has a global security firm. he believes that they did come down pretty hard on these marshals. not all of the details have been disclosed. and he believes these tough punishments might be deriving from that reason secret service scandal in south america. >> perhaps what happened in colombia has filtered through the federal law enforcement community. so the way the information i have is that this investigation preceded that event in the works, colombia happened and there's a lot of pressure from the administration and elsewhere to crackdown on this kind of behavior. >> reporter: the air marshals have turned in their den shalls and weapons >> harris: you think you wouldn't have to put -- you

hoare i'm harris faulkner. bottom of the hour time for the top of the news: seven states and our nation's capital recovering from deadly storms. more than three million still without electricity. on a day when temperatures are soaring into the triple digits thunderstorms strong winds knocking didn't trees and power lines doing a lot of damage to hopes and buildings authorities saying 12 people have died, one reported missing. president obama today declaring a state of emergency in west virginia because of

female recruits. investigators saying there have been 31 victims women who say they've either been victims of sexual assault or misconduct by instructors, all of this happening at lackland airbase in texas over the past two years. first victim coming forward last june. 12 instructors under investigation, nine from the same squadron. molly henneberg on the story for us. the defense secretary weighing in. >> reporter: yes defense secretary panetta says he's very concerned. he says recruits are vulnerable during basic training and military leadership has to make sure instructors, don't take advantage of that situation. >> the command structure from the chairman on down have made very clear to the leadership in this department, that this is intolerable and it has to be dealt with. that we have absolutely no

tolerance for any form of sexual assault. this matter i can assure you is going to be fully investigated. >> reporter: air force leaders say they believe all 31 of the female victims are still in the air force. now their basic training instructors, 12 are under investigation. >> harris: i understand this has gotten the attention of lawmakers in washington. what happens next on that regard? >> reporter: one female member of congress says the military has shown it isn't able to police itself on matters of race and sexual assaults and she wants changes now. >> solution is to take the reporting and investigation of cases of rape and sexual assault out of the military chain of command and place them in a separate office independent of the chain of command with the authority to investigate and prosecute within the military. >> reporter: there are 500 basic training instructors at

lackland. nine of the 12 being investigated in the scandal are all in the same squad. the leader of that squad has been leaved of his post there for an unacceptable level of misbehave by the instructors. he has not been accused of misconduct. >> harris: molly, thank you very much. across our southern border millions of mexicans are headed to the polls this weekend to choose a new president. amid a drug war, that is growing more violent by the hour and increasingly threatening to spill over into the american communities they border, we've seen some of that, whichever candidate takes the presidency must find a way to contain that violence as best as possible. william la jeunesse is he streaming live from mexico city. who is the front-runner? >> reporter: all the candidates say the current strategy has failed and they want to try something new. it is a delicate balance for

the front-runner. he is proposing to go another direction to replace the army with federal police. yet he doesn't want to appear as going light or accommodating cartels. critics consider him an intellectual lightweight who has gotten by on his good looks, his actress wife, related to eight former governors. personally he has admitted to cheating on his first wife and fathering two children out of wedlock with different women. he's leading a party known for corruption and cronyism. >> he's a mystery. he has been very superficial in his proposals so i don't know what is he going to be like. >> he is young, youthful, he comes from a party that mexicans have no illusion it is not a democratic party. there's unsavory characters in the party but a party that was able to get things done. >> reporter: right now he is

leading by 15 points. people go to the polls tomorrow. >> harris: what do the other candidates stand for who are running? >> reporter: you know, it was going to be close, partly when he was asked, three books that affected his life, he couldn't answer for three minutes. also, because of the competition. vasquez was seen as capable, representing the ruling party, cabinet minister twice has led other party in congress, yet she ran a bad campaign and perceived as weak when went faint after a speech. then in second place, lopez he lost the presidency six years ago by less than half a point. but he never was able to put together that same coalition of basically individuals who were advocates for the poor as

>> harris: we've bee te hoare >> harris: we've been telling you millions without electricity -- dealing with major heatwave in western virginia without power in the hundreds of thousands affecting nearly every county, 55 counties there, 53 without electricity. president obama earlier declaring a state of emergency to make sure federal aid and state and local response efforts would go forth. west virginia hit hard during last night's storms high winds ripping apart houses uprooting trees and sending power lines crashing to the ground. it could be days before they rectify the power situation putting them in dire straits governor tomlin joining us now just landed, getting a bird's-eye view of the devastation. governor you and were talking, thanks for joining us by phone. >> thank you for having me this evening harris.

>> harris: you were talking with me moments ago about the fact that you weren't prepared for what saw which was more wind damage than anything else. >> right. we normally have more flooding in west virginia. that's what we are used to dealing with when we have disasters. in this case it was very high winds that hit us and on top of 100 degree plus temperatures that we are having. this is probably, and i would guess probably the largest electric outage we've ever had with 53 of 55 counties reporting outages. it is not a localized problem or just one region. it is statewide and it makes it difficult because you only got so many resources in a state. you can pull from one end to the area when you are localized in this case we have a statewide situation. >> harris: how is your shelter situation? are you able to accommodate
